Terms of Use

What you can do with the service, and what's on you.

Last updated: 2026-10-15

1. Purpose

These Terms of Use ("Terms") govern access to and use of FreeKiosk Cloud, published by RUSHB (full identification in the legal notice), by anyone holding an account (the "User"), independently of the commercial terms of subscription, governed by the Terms of Sale.

Accessing FreeKiosk Cloud implies unreserved acceptance of these Terms.

2. Access and account

Access requires creating an account, attached to an organisation. Anyone creating an account must have the legal capacity to enter into a contract and must provide accurate information. An account is personal; the User is responsible for keeping their password, and their second authentication factor if they enable one, confidential.

Instead of a password, the User may sign in with a Google account. The same rules apply: the account remains personal, and the User is responsible for keeping access to the Google account used for it secure, since it gives access to their FreeKiosk account. Google's own terms govern that Google account.

An account can invite other members into its organisation, with distinct roles. The organisation's owner is responsible for the members they invite and the permissions they grant them.

3. Permitted use

The service is intended for the remote management of Android devices running FreeKiosk that the User or their organisation own or are authorised to administer. The User agrees to:

  • not use the service for unlawful or fraudulent purposes;
  • not attempt to bypass the service's technical limits (device quotas, rate limits, authentication mechanisms);
  • not compromise the security or integrity of the service or of another organisation's data;
  • not display, through an enrolled device, any content that is unlawful, infringes third-party rights, or is contrary to public order;
  • only upload to the media library files they have the right to use and to show where their screens are;
  • not upload files meant to harm the service or the tools that read them.

4. Media library and uploaded files

The dashboard lets the User upload videos and images to a media library, to play them on their screens (digital signage). These files stay the User's. The User gives RUSHB only the right needed to run the service: to store them, to convert them to a format the screens can play (the converted copy replaces the original), to make a thumbnail, and to send them to the User's own screens.

The User alone is responsible for what they upload and show, and states that they hold the rights to it: pictures, videos, music and sound belonging to others, trademarks, and the image of the people shown. Showing a file in a place open to the public can require rights of its own (for music, for example), which are the User's to obtain. The library is not a backup: the User keeps their own copy of their originals.

RUSHB does not review the files and has no general duty to monitor them: they are only inspected technically, to check their format and convert them. A file that does not pass this check, or cannot be converted, is refused and deleted. A quota of storage, shown on the library page, and a limit on the number of uploads per hour apply.

The files of an organisation are private to it: they can be read only through the dashboard and through links of limited duration given to its enrolled screens. This does not make what a screen shows private: whoever can see the screen sees what it displays.

The User can delete a file at any time (a file used in a playlist must first be taken out of it). Files are deleted with the organisation.

Reporting a file. Anyone who believes a file stored through the service is unlawful can write to support@freekiosk.app, with what is needed to identify the file and the reason why it is unlawful. RUSHB handles a report promptly. It may remove or block a file that is manifestly unlawful, and tells the User why, unless the law forbids it; the User can answer. A repeated or serious breach can lead to a suspension, as described below. For these files RUSHB acts as a hosting provider: it is liable for them only under the conditions of article 6 of the French law of 21 June 2004 (LCEN) and of Regulation (EU) 2022/2065.

5. API keys and enrolment tokens

Each enrolled device receives an API key, and every enrolment relies on a single-use token. The User alone is responsible for keeping these safe and for any use resulting from them, including if a device is compromised.

6. Availability and maintenance

RUSHB works to keep the service available but does not guarantee continuous, uninterrupted access. Scheduled (maintenance) or unscheduled interruptions may occur. A device already configured in kiosk mode keeps running on its own during an interruption: only remote management is affected.

7. Liability

RUSHB is not liable for indirect damage resulting from use or inability to use the service, nor for the content displayed by the User's devices, which remain entirely under the User's control and responsibility. The User alone is responsible for the lawfulness of how they use the devices under their management.

8. Suspension and cancellation for breach

RUSHB may suspend or cancel a User's or organisation's access in the event of a breach of these Terms, under the conditions set out in section 9 of the Terms of Sale.

The User can delete their account at any time from the dashboard settings; this deletion is immediate and irreversible, as described in the privacy policy ("Your rights" section).

9. Intellectual property

See the corresponding section of the Terms of Sale and the legal notice.

10. Changes to these Terms

RUSHB may change these Terms at any time; the version that applies is the one in force when the service is used. A substantial change will be flagged in the dashboard.

11. Governing law

These Terms are governed by French law, on the same terms as section 16 of the Terms of Sale.
